TERMS OF SERVICE

These Terms and Conditions are subject to revision without notice. The Client must read and understand these terms before entering into a Commission Agreement with the Artist( Me, Ziznine ). Once the Client enters into a Commission Agreement with the Artist, it is assumed the Client has agreed to all Terms and Conditions.

General

The artist will not work with minors.
Client must agreeing you are 18 or older for ordering any of NSFW/18+.
WIPs will be sent at every stage of the work via email.
If there are any unexpected delays; The Artist will update via public tweets on Twitter.
All drawings will include a signature that may not remove.
Prices are subject to change based on demand.
The artist has the right to refuse any Commission request, without needing to explain the reason (however, the Artist will likely explain reasoning for decline out of courtesy).

Commission Agreement

The artist and client discuss via e-mail, documented in which they agree to,

The subject matter and type of Commission to be produced
The Commission price
The point in time in which is commence in start of work
Commission deadline
Early termination circumstances
Rush fees
Commission can be immediately displayed in the Artist's portfolio or sample of Commission.

This Commission Agreement shall remain on record with the Artist, along with any other documents related to the Commission, for at least two years.

Payment

All prices are in USD and payment through Paypal.
Full payments must be made in the signing of the Commission Agreement prior to the start of work.
Or split 50% upfront and 50% after sketch approval. In the event that payment is made in installments ( 50% up-front ), ownership of the Commission will only pass from the Artist to the Client on receipt of payment in full.
The Commission will not be sent to purchaser until the agreed payment amount has been received.
The artist will confirm payment once drafts have been seen and agreed upon by the client; any further work on the Commission will be with-held until this agreement is made and payment received.
Don't send payment before the Artist have agreed to give you a slot and requested you to send me the payment.

NOTE: All prices are specified as USD. It is the Client's responsibility to ensure that they have converted currencies based on current exchange rates.

Copyright And Usage policy

The artist are claim the rights to the produced drawing, not the buyer.

Therefore artist allowed to use the copyrighted artwork to:

Promote artist themself with it everywhere
Publish books with it (artbooks, etc.)
Display it everywhere to my liking (website, social media, etc.)
Post it wherever the artist want
If client wants to add my design which is I have to create new design for client, the artist will charge extra for it. And artist claim the rights to the design, not client.
The artist do not claim any rights to characters and other intellectual properties used in process of creation.

The client(buyer) is allowed to:

Use the commissioned piece for personal use unless agreed otherwise (client can upload it on all your social media profiles, forums, etc.)
Print the artwork and claim the character(s) as their own, but not the artwork itself.
Use the artwork to promote themselves. Client are not forced to give artist credit when you post it but it is very appreciated.
Use the artwork on their Youtube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.

The following is considered copyright infringement:

Reproducing/using the copyrighted artwork commercially - means making money off it in any way.
Claiming the artwork as client(buyer) own
Removing artist's signature from the artwork
Altering the artwork without artist's consent
Under no circumstances may the Client submit a Commission to any kind of online or offline contest.

The artist reserve the full rights to the image and it's use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time).

Refund

The buyer is not allowed a refund once I started working on the commission.
If for any reason artist are unable to start client's commission they will receive a full refund.
If the artist cancel client's order before the artist started it, client can get a full refund.
If the artist are getting a refund, do not request a Paypal chargeback. artist will transfer the money back to client.
If the Client is unsatisfied with the Commission for an appropriate reason, they must contact the Artist within seven days of receiving the final Commission.
Disliking the Commission or change of mind are not considered for a refund; this is minimalised by providing drafts and progress photos throughout the Commission process.
If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all before mentioned rights to the commissioned piece. and artist will have the full right about it.
